Terms of Service
By engaging Simplfico for any service, you agree to the following terms. Simplfico LLC is a New Jersey limited liability company.
Scope of services. Simplfico delivers the services described in the signed engagement letter or web order — typically an Operations Quick Start build or an ongoing Marketing OS engagement. Fees are quoted directly to each client. Anything outside the agreed scope is a separate engagement.
Ownership. Once a Quick Start is delivered and paid for, the client owns all automations, accounts, prompts, and documentation produced. Simplfico retains no rights to the deliverables.
Payment. Quick Start fees are due before build begins. Ongoing engagement fees are billed in advance per the schedule in the engagement letter. All fees are in USD.
Bug-fix window. Every Quick Start includes a 14-day bug-fix window from delivery. If something Simplfico built stops working in that window, Simplfico will fix it at no charge. Changes to scope, third-party tool changes, or upstream API breakage outside that window are billable.
Cancellation. Marketing OS is month-to-month. Either party may cancel with written notice before the next billing cycle.
Liability. Simplfico's total liability for any claim is limited to fees paid by the client for the engagement giving rise to the claim. Simplfico is not liable for indirect, incidental, or consequential damages.
Governing law. These terms are governed by the laws of the State of New Jersey. Disputes will be resolved in courts located in Morris County, New Jersey.
Privacy Policy
Simplfico collects only what's necessary to do the work and respond to inquiries.
What we collect.
- Waitlist / sample-request form: the email address you enter, plus the timestamp of submission. Stored at Formspree.io and accessible only to Simplfico.
- Quiz responses (when live): business name, contact email, and the answers you give us about your operations.
- Engagement records: for paying clients, the information needed to deliver and invoice services.
What we don't collect. Simplfico does not run third-party tracking pixels, ad-network scripts, or analytics on simplfico.com at this time. There are no cookies set by Simplfico beyond what your browser uses for the page itself.
How we use it. To respond to you, deliver the services you ask for, and send the once-at-launch email you signed up for. We do not sell, rent, or share your data with third parties for marketing.
How we store it. Form submissions are stored at Formspree.io. Client engagement data is stored in standard business tools (Gmail, Google Drive, QuickBooks, etc.).
Your rights. Email [email protected] at any time to ask what we have on you, request a copy, or have it deleted. We respond within 7 business days.
AI Disclaimer
Simplfico builds automations that incorporate AI models (including the Anthropic Claude API) and AI-driven services. Honesty about how that works:
- AI drafts; humans approve. For marketing content, AI produces a draft. A human reviews every piece before it reaches your customers, your inbox, or any public channel.
- AI is not making business decisions. Automations are tools the client controls. They route, draft, and respond — they do not authorize spending, sign contracts, or act on the client's behalf in ways the client hasn't explicitly approved.
- AI output can be wrong. Models occasionally produce inaccurate, outdated, or off-brand content. The 14-day bug-fix window covers automations that misbehave, but the client is responsible for reviewing any output before it goes to a customer.
- Third-party services change. AI providers, email APIs, calendar APIs, and other tools we build on can change behavior or rate limits over time. Simplfico will flag known changes; ongoing maintenance after the bug-fix window is offered as a separate engagement.
- No data is sent to third-party AI services without disclosure. The exact tools and models used in your build are listed in your handover documentation.
